EEOC ELIMINATES REGULATION ON DISMISSAL OF CHARGES

On January 18, 2008, the EEOC published a notice in the Federal Register (73 FR 3387) announcing it is eliminating three bases for dismissal of charges in its procedural regulations because they are no longer needed to accomplish the EEOC’s case management goals. The effective date for this action is February 19, 2008. The regulation eliminates a regulation that permitted dismissal of charges under Title VII or the Americans With Disabilities Act when the charging party could not be located, failed to cooperate with EEOC, or rejected an offer of full relief.
