Colorado Delays Implementation of AI Law

By Dave Schmidt

On August 6, 2025, Governor Jared Polis issued an Executive Order to hold a special session of the Colorado General Assembly to address budgetary issues stemming from the passing of H.R. 1., also known as the One Big Beautiful Bill Act. Among the many items on the agenda to be addressed in the special session was the need to revisit the scope and timeline for Senate Bill 24-205 (SB 24-205). SB 24-205 was passed in 2024 to regulate the use of artificial intelligence (AI) in, among other things, employment decision-making. For a breakdown of key elements of this law, visit our previous blog.

The special session began on August 21, 2025. After several days of discussions related to amending the scope of Colorado’s AI law, talks stalled out without an agreement being reached. However, Colorado has decided to delay the implementation deadline from February 1, 2026, to June 30, 2026.

It remains to be seen if this extension will result in further discussions of the scope of this law during the regular congressional session or if this law will be implemented as currently written.

DCI will continue to monitor this and other updates related to regulating the use of AI in employment decision-making.
