DOL REGULATORY UPDATE

by Patricia Schaeffer, Vice President-Regulatory Affairs

VETS:
On October 3, 2007, the Department of Labor’s Veterans’ Employment Training Service (VETS) published a notice in the Federal Register (71 FR 56103-56104) soliciting comments on the proposed VETS-100A form. Comments are due no later than December 3, 2007.

OFCCP:
The Office of Management and Budget (OMB) is currently reviewing OFCCP’s proposed rule entitled “Government Contractors, Affirmative Action Requirements, Maintaining and Analyzing Race and Ethnicity Data of Applicants and Employees.” According to the OFCCP, this proposed rule would amend certain sections of the Office of Federal Contract Compliance Programs (OFCCP) regulations to correspond to the new Employer Information Report (EEO-1 Report), as published in the Federal Register on November 28, 2005 (70 FR 71294) (EEO-1 Notice). The new EEO-1 Report contains revised racial and ethnic categories and job categories. OMB’s review of a proposed rule is typically the last step before the draft regulation is published in the Federal Register.
