OFCCP’S PROPOSED RULE ON RACE AND ETHNICITY DATA EXPECTED SOON

Since October 1, 2007, the Office of Management and Budget (OMB) has been reviewing OFCCP’s proposed rule entitled “Government Contractors, Affirmative Action Requirements, Maintaining and Analyzing Race and Ethnicity Data of Applicants and Employees.”The proposed rule will amend certain sections in its regulations to correspond to the new Employer Information Report (EEO-1 Report), as published in the Federal Register on November 28, 2005 (70 FR 71294) (EEO-1 Notice). The new EEO-1 Report contains revised racial and ethnic categories and job categories. OMB’s review of a proposed rule is typically the last step before the draft regulation is published in the Federal Register.
