On September 29, 2008, Sen. Edward Kennedy (D-MA) introduced a new bill (Employee Misclassification Prevention Act, S. 3648) that would amend the Fair Labor Standards Act to clarify that misclassification is a prohibited act and to allow for harsher penalties.
