Breaking News: EEO-1 Component 2 Update

DCI staff just left the courtroom and the order is in. EEOC will announce to employers and post in the Federal Register by April 29 that data collection will begin and employers should prepare to collect and report by September 30, 2019. The court gave EEOC the option to either collect 2017 and 2018 data by September 30, 2019, or they can opt to only collect 2018 data by September 30, 2019 and 2019 data by March 31, 2020. EEOC is required to keep the EEO-1 Component 2 portal open until at least the average number of historical filers or more have been met. EEOC must make that decision by May 3rd and inform the court. EEOC must file a status report to the court every 20 days starting on May 3rd . Finally, the judge imposed tolling on the form and it now expires on April 5, 2021. DCI will continue to update as the story progresses.
