Coming Soon: NPRM on Non-Retaliation for Disclosure of Compensation Information

On Wednesday, September 17th, the NPRM on EO 13665 will be published in the Federal Register. This proposed rule is for the implementation of Executive Order 13665, which prevents retaliation against applicants and employees of federal contractors on the basis of discussing compensation information. Specifically, EO 13665 states that contractors are prohibited from retaliating or discriminating against applicants and employees who have “inquired about, discussed, or disclosed the compensation of (themselves) or another employee or applicant.” Under this order, the US Department of Labor hopes to prevent pay equity issues from going unnoticed in the workplace.

As with all NPRMs that affect the federal contractor community, DCI strongly recommends that you review and provide comments within the 90-day public comment period.
