On February 15, 2024, the Department of Labor (DOL) filed a notice of appeal to the December 2023 court decision ordering the Office of Federal Contract Compliance Programs (OFCCP) to release the consolidated EEO-1 reports of federal contractors that previously objected to their release. The release was scheduled to occur on February 20, 2024.
DOL has requested a stay while the appeal is pending with the 9th Circuit Court of Appeals. In response, the US District Court for the Northern District of California granted a temporary stay to allow the court time to consider DOL’s arguments. The court has given the plaintiff, the Center for Investigative Reporting (CIR), until February 23, 2024, to file a response to this motion.
The appeal and stay are just the latest developments in CIR’s efforts to obtain the consolidated EEO-1 reports of federal contractors. The consolidated EEO-1 reports being sought by CIR contain the aggregated ethnicity/race and gender makeup of federal contractors’ respective US workforces for the 2017 and 2018 reporting years. These reports were originally requested by Will Evans of CIR in January of 2019.
