EEO-1 Pay Data Collection – The Saga Continues with a Hearing Scheduled Next Week

Yesterday, April 11, 2019, Judge Chutkan scheduled a hearing for 2 p.m. (EDT) next Tuesday April 16, 2019, for all parties to attend in regards to her order to reinstate the EEO-1 pay data component 2 obligation. 

The hearing will include representatives from EEOC, OMB, and other agency or department representatives that “have particularized and thorough knowledge of all the issues addressed…to effectuate the Component 2 pay data collection.”  Additionally, the Order issued yesterday granted pending motions for leave to file Amici Curiae briefs of the Chamber of Commerce, DirectEmployers Association and American Society of Employers.  The briefs were filed on behalf of various employer representative groups outlining burden and obligations for this data collection to employers.
