Following Judge Chutkan’s reinstatement of Component 2 of the EEO-1 report in National Women's Law Center v. Office of Management and Budget, the Department of Justice filed a Notice of Appeal of the ruling on May 3rd. The appeal will be reviewed by the U.S. Court of Appeals for the District of Columbia Circuit.
Despite the appeal, employers should still be prepared to submit their 2017 and 2018 pay data to the EEOC by September 30th, as the appeal filing does not stay the district court orders or change the current obligation to submit Component 2 data. The EEOC has issued a statement addressing the appeal on their website. A formal contract was awarded on May 1st to NORC at the University of Chicago, and data collection is expected to begin in mid-July. The agency and NORC team will schedule regular meetings to discuss the project’s progress, as well as to establish a help desk that will be available to assist employers in filing their reports.
