On Friday, November 20, the Department of Defense Pricing and Contracting Director issued a notice on Class Deviation 2021-O0001 – Combating Race and Sex Stereotyping. This notice puts into place Section 4 of EO 13950, which requires contractors subject to EO 11246 requirements to include a new clause for solicitations issued on or following November 20, 2020, as well as in any subsequent contracts that will include the clause at FAR 52.222-26, Equal Opportunity (see attachment within the Class Deviation Notice for required language). It also requires contractors to post notices to employees, applicants, and union officials.
Furthermore, contractors must modify solicitations preceding November 20, 2020 to include the new clause, as well as in any anticipated contract awards, on or following November 20, 2020, if the clause at FAR 52.222-26, Equal Opportunity is contemplated to be included in that contract.
This class deviation is effective immediately and will remain in effect until either added to the FAR or rescinded.
