OFCCP Announces 16 Additional Megaprojects

By: Evan Szarenski and Bill Osterndorf

The U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) has been heavily focused on construction projects since 2020. On Thursday, April 25th, OFCCP designated 16 federally funded construction projects as Mega Construction Projects for agency scrutiny, bringing the total number of such Megaprojects to 40.

OFCCP relaunched the Megaproject program in March 2023. As part of the program, OFCCP provides compliance assistance and linkages with recruitment resources for contractors working on designated Megaprojects. In addition, OFCCP will conduct compliance reviews of all prime contractors and some subcontractors on each designated Megaproject. To be eligible to be designated as a Megaproject, a construction project must be federally funded, have a value of over $35 million, and have a duration of over a year.

There are two or three Megaprojects in each of the six OFCCP regions on the most current Megaproject list. The projects selected have not yet reached the construction stage. This list included projects funded by the following agencies:

  • Department of Energy
  • Department of the Interior
  • Department of Transportation
  • U.S. Army Corps of Engineers

OFCCP had not previously selected any projects from the Department of the Interior and the U.S. Army Corps of Engineers as Megaprojects.

DCI will continue to monitor updates in the construction space and post updates on the DCI blog.
