OFCCP Announces Proposal Policy on EO 11246 Religious Exemptions

OFCCP has announced a proposal to rescind the final rule “Implementing Legal Requirements Regarding the Equal Opportunity Clause’s Religious Exemption,” which has been in effect since Jan. 8, 2021. The Federal Register will publish the proposal to rescind on Nov. 9, 2021. 

OFCCP states that the rescission would preserve the Executive Order 11246 religious exemption and ensure that said exemption is interpreted and applied consistent with Title VII principles. In effect, this would return OFCCP policy and practice to that of the George W. Bush and Barack Obama presidencies.  

OFCCP has supplied the following resources for contractors and other stakeholders to understand the proposal. 

A public comment period regarding the proposed recission will end on December 9, 2021.
