OFCCP Revisits Use of EEO-1 Pay Data

The U.S. Department of Labor has issued a notice in the Federal Register stating that OFCCP plans to evaluate the 2017 and 2018 EEO-1 component 2 pay data to assess the utility for providing insight into pay disparities across industries and strengthen efforts to enforce pay discrimination.

This notice rescinds a prior notice in the Federal Register and is effective immediately. 

This is a reversal from its stance during the Trump administration, in which EEO-1 pay data was not considered necessary or useful and that OFCCP “did not intend to request, accept, or use EEO-1 Component 2 data.”  

This stance has now been revised. The notice states that “OFCCP believes the position taken by the agency in the November 2019 notice was premature and counter to the agency’s interests in ensuring pay equity.”
