OFCCP Announces Interim Enforcement Position On Mandatory Job Listing Requirement

OFCCP has been working with the Office of Management and Budget (OMB) for the past several weeks to finalize regulatory changes to the mandatory job listing requirement that is required by the Jobs for Veterans Act. OFCCP had previously indicated it would publish a final rule by July 1, which is the date America’s Job Bank ceases to be operational. OFCCP has not yet released its final rule.

UPDATE: OMB completed its review of the rule on August 1, 2007. The final rule was published in the Federal Register on August 8, 2007.

On June 25, 2007, OFCCP announced an interim enforcement position on the mandatory job listing requirement. As a matter of “enforcement discretion,” OFCCP announced that until it provides further guidance, it would not cite a contractor for non-compliance solely because it had failed to list all of its employment openings with the appropriate employment service delivery system or the appropriate local employment service office, provided that it continued to make good faith efforts to recruit and employ qualified covered veterans.
