California Pay Data Reporting Portal Set to Open

On February 1, 2024, the California Pay Data Reporting site updated to reflect the 2023 reporting period. According to FAQs on the site, the portal is set to open as of that day. However, the portal itself indicates that users will not be able to log in until February 2, 2024. The California Civil Rights Department (CRD), which is responsible for the collection of this data, had previously indicated that this year’s filing is due on May 8, 2024, consistent with its announcement in 2023 that filings would be due the second Wednesday of May each year.

A new user guide for the 2023 reporting period was also published. 

Updates to the FAQ Page 

CRD has published several announcements on the FAQ page for the 2023 reporting year. Several announcements are critical for this year’s filings: 

  • Filers should not use templates from previous years as this format will be rejected by the system. 
  • A new data field has been added to collect information regarding whether employees worked remotely during the snapshot period. 
  • Labor contractors can no longer be reported with unknown race/ethnicity or sex. This was allowed in last year’s filing period since it was the first year of submitting information on labor contractors. 

Fourth Year of Filing 

This is the fourth year the CRD has required employers to submit compensation information. As a reminder, employers with 100 or more employees with at least one employee in California are required to file the California Pay Data Report annually.  

Employers must submit employee data grouped by establishment, pay band (based on W-2 Box 5 earnings), EEO-1 job category, and race/ethnicity and sex. For each of these groups, employers must include the count of employees included, the mean and median hourly rates, and total hours worked. The data submitted must reflect a single pay period between October 1 and December 31.
